Is CBD Oil Legal in Florida & Other States?

CBD has been used by people in America since time immemorial, and yet, it’s legality in the modern world has always been a question of confusion as well as complication. What is CBD oil?

CBD oil is one of the many formulations of CBD compounds. CBD, also known as cannabidiol, is a cannabis compound and naturally-occurring. It is non-psychoactive since it contains less than 0.3% of tetrahydrocannabinol or THC, which is another compound primarily responsible for producing high. The history of CBD’s legal status in the US

Before we discuss the legality of CBD oil in 2020, let’s throw some light on the history of this compound.

1.      Controlled Substance Act, 1970 – The first known legislation related to CBD was discussed in the Controlled Substance Act, 1970, where the then federal government classified CBD (hemp) as a Schedule I drug, alongside heroin.

2.      2014 Farm Bill – It was quite a while after another legislation was brought in question after the above mentioned Act. The 2014 Farm Bill finally gave the required nudge to CBD when hemp was legalized under section 7606. As per this section, hemp, defined as Cannabis Sattiva, was made legal in the US as long as it contained less than 0.3% of THC in its body. The hemp was then available for sale and production of industrial hemp as well as research and agricultural purposes.

3.      2018 Farm Bill – This act is certainly the most significant in explaining the legality of CBD in the US.  With an attempt to bring medicinal value and healing qualities of CBD to the country, the Government passed The Hemp Farming Act, 2018, which was included in the Farm Bill.  The act was officially referred to as the Agricultural Improvement Act of 2018.

      The hemp was defined as, “the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis.”

 The compound has also been omitted from the list of ‘Controlled Substance’ now.

This Bill was the final stamp on CBD being legal on a federal level in all the 50 states of the US. This also includes CBD oil and other formulations. However, each state in the US is governed by its own local laws, so it is important to know about the legal status of CBD oil in every state on an individual level.

CBD and state laws

As mentioned above, each state in the US decides the legality of CBD oil individually. Thus, one might have to consult the local laws of the same. The 2018 Farm Bill has certainly given an upper hand to the states to allow or restrict the production and sale of CBD oil and related products.
