Is It Illegal to Have a CBD Vape Pen in the US?

In states such as California and Colorado, where it is legal to use cannabis products for both recreational and medical purposes, you can use CBD vape pens regardless of their THC content. Note however, that San Francisco has a ban on vape pens altogether. In other states, such as Texas and New York, it is essential to pay much closer attention to the vape products that you purchase.

CBD vs. THC in Vape Pens

CBD and THC are the two main cannabinoids found in hemp and cannabis plants. CBD is linked to the plant’s potential health benefits and is popular throughout the United States. THC, on the other hand, is the main cannabinoid responsible for the intoxicating effects that are felt when using cannabis for recreational purposes.

In order for products to be sold as CBD health products, they cannot contain more than 0.3%. Products that contain more than 0.3% are considered to contain enough THC to cause noticeable effects, and therefore they cannot be marketed as a health product.

Many brands use CBD isolate in their CBD vape pens. In order to create CBD isolate oils, intensive filtration methods are used whereby all cannabinoids and terpenes other than CBD are removed. CBD isolate vape pens are guaranteed to be free from THC, meaning that they are legal to use across the US.

Full-spectrum CBD oil can also be used to create CBD vape pens. Full-spectrum CBD contains all the natural cannabinoids that occur within hemp and cannabis plants. In order to be sold as CBD vape pens, gentle filtration is used to ensure that the oil used contains no more than 0.3% THC.
